The grounds of Martin Oaks are open daily, 7 days a week, from Sun Up to Sun Down.
Bringing drugs or alcohol onto the cemetery grounds is strictly prohibited.
When paid in full, interment rights owners are issued a deed (Certificate of Ownership for Right of Interment) that describes the exact location of the grave plot(s). The issuance of such deed is the sole form of recognition of ownership. The owner of interment rights may dispose of such rights by will, or should the owner die intestate, they may pass such rights according to the laws of Texas governing intestacy. Any space in which there are no burials may be transferred to a new owner, providing the original deed is submitted to Martin Oaks along with a proper transfer agreement.
Because Matin Oaks sends required notices or other information to the last recorded address, owners are required to notify Martin Oaks of any change of address. Such notices shall be deemed adequate.
Graves shall be dug by grave service companies approved by Martin Oaks only.
Martin Oaks retains the right to enter upon any adjoining spaces(s) to perform its duties with regard to subsequent interments or erection of monuments without prior notice to the owner of said spaces.
The person(s) with Right of Interment shall place, or cause to be placed, a temporary marker designating the name of the person interred. Temporary markers shall be constructed of sufficient material to remain legible and withstand environmental conditions for a six-month period or until a Permanent Marker is installed.
All graves shall have a permanent marker installed within 6 (six) months of the interment.
Any monuments not purchased from Martin Oaks are subject to the approval and consent of Martin Oaks.
The material, design, size, color, workmanship, inscription, and location of monuments, as well as all other work and improvements on burial spaces, are subject to the approval and consent of Martin Oaks. Photographs, porcelain material, protective glass, and other breakable materials of any kind may not be incorporated into any memorial. Owners of burial rights are encouraged to obtain written approval from Martin Oaks before purchasing materials or contracting labor for any project. Martin Oaks reserves the right to prohibit any such work or the erection of improvements that Martin Oaks considers objectionable for any reason, and any work done or any improvements erected without the approval and consent of Martin Oaks may be removed and the space may be restored to its original condition by Martin Oaks at the expense of the owner.
Cemetery Rules and Regulations
The natural living beauty of nature is a tribute we can dedicate to the memory of loved ones interred at Martin Oaks Cemetery. Martin Oaks Cemetery adheres to the following guidelines for the benefit of all. The following rules and regulations govern the care and use of lots in the cemetery and are intended not as a restraint but as measures to create and preserve the beauty of the cemetery.
One grave space shall be limited to the interment of one (1) adult burial or two (2) infant burials or three (3) single urn cremated remains. However, designated spaces for infant burials and for the burial of urns of cremated remains are also an option.
Fencing, railing, hedging, curbing, raised borders, trellises, artificial lighting, glass items or other ornaments, toys, or any items which interfere with mowers or other maintenance equipment are not allowed around burial spaces or on graves and may be removed without notice.
Chairs, benches, or any other structures that interfere with mowers or other maintenance equipment are prohibited and may be removed without notice.
Floral tributes or other decorations may be removed from burial spaces and graves as soon as they become unsightly, unseasonable, dangerous, are oversized, or non-conforming to these standards.
Graves must be filled in level with the ground. Grave mounds interfere with mowing operations.
Martin Oaks prohibits owners from planting of any tree, shrub, or plant on cemetery spaces or graves, and reserves the right to remove all unsightly and forbidden objects, including trees, shrubs, or plants which are otherwise prohibited.
Martin Oaks is not responsible or liable for any damage to any improvements or monuments in the cemetery, or for the removal, loss, or damage to any article of personal property left on the ground.
Martin Oaks expressly reserves the right to make other and additional Rules and Regulations or to amend these Rules and Regulations without prior notice and at its discretion.
